Under the Control of Asbestos Regulations 2012 (CAR 2012), anyone responsible for managing non-domestic premises has a legal duty to manage asbestos (Regulation 4). This means having accurate information on where asbestos may be present, assessing the risks, keeping an up-to-date asbestos management plan, and making sure the right people get the right information before any work is carried out.

Asbestos Surveys
We review your existing surveys to make sure they follow HSE guidance (HSG264: Asbestos – The Survey Guide). We check that you have the right type of survey (management or refurbishment/demolition), that it’s been carried out by a competent organisation, and that results have been properly recorded.
Asbestos Register
Regulation 4 requires a register of known or presumed asbestos-containing materials (ACMs). We assess whether your register is clear, accurate, and up to date, and whether it links correctly to survey information.
Management Plan
The regulations require you to have a written plan that explains how you will manage the risks from asbestos. We check whether your plan includes risk assessments, responsibilities, communication arrangements, and whether it has been reviewed within the last 12 months.
Re-inspections and Updates
The HSE expects registers and management plans to be reviewed at least once a year (or sooner if the condition of ACMs changes). We check that regular re-inspections are being carried out and recorded.
Information Sharing
Regulation 4 also requires that anyone who may disturb asbestos — such as contractors or maintenance staff — is given the right information before starting work. We look at how you provide this information (for example through inductions, permits-to-work, or contractor packs).
Training and Competence
Regulation 10 requires appropriate asbestos training. We check whether staff and contractors have received asbestos awareness training or, where relevant, training for non-licensed or licensed asbestos work.
Work with Asbestos
If asbestos removal or repair work has been carried out, we look at whether it was correctly classified (licensed, notifiable non-licensed, or non-licensed), properly notified to the HSE where required, and whether clearance certificates and air monitoring records are in place (following HSG248: The Analysts’ Guide).
